Hello Hui,

Attached is our request for information regarding Kaufman Crushing and Eckman Creek Quarries.

I spoke with David Kaufman yesterday morning. He maintains  he has “no restrictions” on operations.

I also spoke with Vaughn Balzer of Dogami.  He said Lincoln County is the authority regarding regulating hours and days of operations.

We would appreciate as soon as possible, a copy of the operating permit for Kaufman Crushing, Eckman Creek Quarries.

Today,  9/15/2016:   While operations again began before 7:00 AM, the drilling and major noise/annoyance did not begin until 6:40 AM.

We  look forward to resolving this in the least contentious manner. We would be happy to discuss this further, or meet at any convenient time.

We would like to please be notified in advance,  of the next scheduled  meeting of the Lincoln County Planning Commission.

Good Morning to all of you,

Eckman Creek Quarry operations began again early this morning. Drilling began at 6:30 AM.

We tried to resolve this earlier this year. We filed an official complaint.

We appeal to you to make a decision today, Friday 9.16,  as to what the approved days and hours of operations are.

Please scan and e mail us a copy of the most recent operating agreements between ECQ and Lincoln County.

Dear Hui,

We know you are busy and we hate to be annoying, but timing is important today. We need to review the operating permits of Eckman Creek Quarries asap.

It is Friday morning and we all have busy schedules.

Regrettably, the permitting and otherwise enabling of Eckman Creek Quarries, operations, possibly outside of allowed uses, would be a violation of county code.

The lack of response by county officials is tantamount to encouraging these actions.

We attempted to point this out in our complaint filed early 2016. Sadly, only one specific aspect of the complaint was addressed, and that was by referring it to Dogami.

Below in bold is a copy of our complaint filed.

If this is not resolved TODAY, the possible violations of use, and county codes,  will continue throughout the weekend. Saturday and Sunday, and then again early Monday morning.

We appeal to the Lincoln County Planning Dept. to please  inform today,  Eckman Creek Quarries operator David Kauffman, of permitted  operating hours of  Monday to Friday  8:00 AM – 5:00 PM  until all required, hearings are held and  permits are obtained.

Quarry operates outside of State and County, Days and Hours guidelines.  Operator wrongly believes his “Grandfather Clause” operating permits, allow 24/7 operations that  include expansion areas obtained after permits were issued.  Only the original 18 acres are included in the  grandfathered  exemption.  Additional USFS leased land and other lands, are NOT exempt from State and County  regulated days, hours and safety guidelines.  Operations occur  in the dark with heavy equipment  operating only with head lights, on steep slopes.  Sunday  operations  occur  off the original  exempt  18 acres. Recent violation dates  Sunday Jan.24 and following week working in the dark.

Any progress on this request for information?

We used to receive notice in the mail, prior to blasting at Eckman Creek Quarry.

There has been blasting today 9/21   There were no whistles or typical warnings of any kind.

I included some general blasting guidelines below.

    Ten minutes prior to and immediately after each blast, all access to the specific area will be

safeguarded from unauthorized entry. The warning signal prior to each blast shall be from an air

horn, siren, or other device audible to at least one half mile from the blast (list specific type of

device). The warning will be given three (3) minutes prior to detonation and will consist of three

(3) short blasts of five (5) seconds duration with five (5) seconds between each blast. The all

clear signal shall be one long blast from an air horn, siren, or other approved devices of twenty

(20) seconds duration (list specific device).

     Blasting shall be conducted in such a way so as to prevent adverse impacts to the public or

the envirornment

An extensive search of our records yielded no county land use permits for Eckman Creek Quarries.  Please find attached DOGAMI permit for the subject quarry.   DOGAMI permit predates land use regulations in Lincoln County.

We are now looking at state rules regarding your concerns.
